I actually did not read the title of the thread. Although I respect the Somali way of paying compensation, I disagree that a crime like rape or murder can be compensated with material things or money.

A person who commits crime or rape should serve time in prison.

Wrong...to be considered an elder you have to have 2 criteria:

-Seniority (unlike you we respect the elderly and look forward to old age)
-Respect/Good name in the community.

You cannot have respect or good name if you are an ignorant village bumpkin. You can be illiterate (the prophet AS was unlettered) but you have to demonstrate a kind of 'wisdom' and certainly knowledge of the canon and atleast an oral understanding of precedent in similar legal rulings. More often than not, an elder is someone with an extensive education, profession or businessman. Even warlords had to respect these individuals, so they cant be just anybody.

The only group of people who seem to have no regard for an elder, or the xeer or even their tol' (lineage) are al Shabaab terrorists and western Somalis who have assimilated and dont know what the hell Im even talking about.

Totally agree with that.
But as Viriato said it's a common practice in muslim world to make the rapist marry the victim. Moroco bolish the possibility for a rapist to avoid jail by marrying his victim only recently.
So what should we conclude about muslims?
