Lamar Smith Says Founding Fathers Didn't Want Gay Marriage

In yet another instance of House Republicans focusing on social rather than fiscal issues, a subcommittee of the House Judiciary Committee on Friday held a hearing examining the Obama administration's decision not the defend the Defense of Marriage Act (DOMA) in court because they found a provision of the law unconstitutional.

Several Republicans including Rep. Lamar Smith (R-TX), chairman of the House Judiciary Committee, bashed the Justice Department's decision not to defend the law. House Speaker John Boehner (R-OH) said last month that Congress would hire counsel to defend DOMA itself following a party line vote of the Bipartisan Legal Advisory Council.

The DOMA thing was initiated by other groups filing lawsuits to have it declared unconstitutional, so the government does have to hire attorneys to defend the laws it passes. Otherwise there would be no point to Congress passing laws, or even having a Congress at all, if they were just going to give up any time any one of 320 million people objects and files a lawsuit against it.

If you're looking for an outrage in this vein, there's a letter signed by 41 Senators asking the Justice department to start prosecuting more people for pornography (not child porn, regular porn) under 'obscenity' laws of questionable Constitutionality. It was initiated by Utah Senator Hatch, and signed by 34 socially conservative Republicans and also Democrats Amy Klobuchar, Diane Feinstein, Joe Lieberman, Bill Nelson, Ben Nelson, and Tom Carper.
