Germany’s AfD party wants to take Angela Merkel to the country’s Constitutional Court for her decision to open the country’s borders in 2015. By bypassing the parliament, Merkel violated the constitution, the party claims.
The populist AfD party announced on Friday that it filed a complaint against Merkel for her 2015 decision on migration. According to the party, Merkel should have consulted the German parliament on such a crucial issue.
During the migration debate in August 2015, Merkel spoke the words “Wir schaffen das” (We can manage this) to signal the country was ready to deal with the refugees that would be coming to Germany.
With Germany suspending the Dublin Regulation as well, it motivated millions of refugees and migrants to come to Europe. Germany’s Federal Office for Migration and Refugees (BAMF) has made 1.65 million asylum decisions between January 2015 and March 2018.
The AfD said the complaint is focused on the September 2015 decision to keep the border between Austria and Germany open. The lawsuit needs to expose the “tyranny of the unjust”, the party says.
The court still needs to make the decision whether the complaint can result in a formal lawsuit.
