    No, they apply to the courts for the estate to pay out the debt from assets prior to beneficiaries recieving their share. It's all rather normal mundane procedure. If there are no assets but you're married, the spouse carries that debt. Again, normal mundane procedure.

    Different countries may have different rules.

    They can sue her estate. If he sells his home or some other property that he held with her they will collect the debt through the selling of that property based on successfully suing him prior to selling the property. That's often how past debts are collected.
