India bans Muslim men from instantly divorcing their wives by saying 'talaq' three times

India's Supreme Court outlawed the 'triple talaq' last year - but the country's cabinet has now approved an executive order to make the practice a punishable offence.



The government has been trying to pass legislation to 'explicitly ban' the procedure.

In an Independence Day speech last month Modi said he would 'not stop till they get justice,' referring to the women.

Most of the 170 million Muslims in India are Sunnis governed by the Muslim Personal Law for family matters and disputes.

Prasad said that nearly 22 countries, including neighboring Pakistan and Bangladesh, have banned the practice and appealed to the opposition to approve the Muslim Women Protection of Rights on Marriage Bill.

That idea, as bizarre as it is, is not “extremist,” it is standard, Qur’anic Islam. If a man says “talaq,” you are divorced, to his wife, then she is divorced. But he can tell her to come back after he says it once, and do this again after he says it a second time. But if he says it three times, then she has to marry another man, consummate the marriage, and be divorced by him before she can return to her first husband, should he wish her to return.

This is all based on the Qur’an: “Divorce is twice. Then, either keep her in an acceptable manner or release her with good treatment. And it is not lawful for you to take anything of what you have given them unless both fear that they will not be able to keep the limits of Allah . But if you fear that they will not keep the limits of Allah, then there is no blame upon either of them concerning that by which she ransoms herself. These are the limits of Allah, so do not transgress them. And whoever transgresses the limits of Allah, it is those who are the wrongdoers. And if he has divorced her thrice, then she is not lawful to him afterward until she marries a husband other than him. And if the latter husband divorces her, there is no blame upon the woman and her former husband for returning to each other if they think that they can keep the limits of Allah. These are the limits of Allah, which He makes clear to a people who know.” (Qur’an 2:229-230)

Moradabad, Sep 15: In a shocking incident, a woman in Uttar Pradesh was given a talaq after she mistakenly increased the volume of the music system, which angered her husband. The woman alleged that she was gang-raped after her husband gave her triple talaq. According to reports, the woman has filed a complaint with the Moradabad police alleging that she was asked to perform halala, a practice in which a woman divorcee marries someone else, consummates the marriage and then gets a divorce. This makes her lawful to the former husband.

An investigation into the matter has been initiated. A case has been registered into the matter. Reports inform that the Police has filed a case against six people on Friday on the complaint of a woman. The victim’s father said that her daughter was given a triple talaq after she mistakenly increased the volume due to which her husband was angry and took this step.
