Course it is in both cases, but it’s not that simple. Vast majority of our mental processes are done on subconscious level. Human brain is ultimately just glorified chemistry and in the second scenario it wouldn’t go with rational analysis, but would rather follow the same pattern as if that was any other man. Things are more efficient that way – like, how often does that stuff happen? Humans never were under any selection pressure to distinguish. In order to have some sort of 'he’s infertile, so it’s kinda ok‘ reaction, we would need some signifiant, large scale benefit to this recognition machine in our brains to evolve. Actually, I find that qualitatively different from my wife having sex with another man.
