The 60-year-old man says the picture of his leg was used on cigarette packets without his consent

A 60-year-old man in eastern France says he was stunned to discover that a picture of his amputated leg had been used on cigarette packets, as a warning against smoking, without his consent.

The picture was displayed alongside the message "smoking clogs your arteries".

But the Albanian man, who lives in Metz, says he lost his leg as the result of a 1997 shooting in Albania.

The European Commission, which is responsible for the distribution of such images, says the man is mistaken.

The man's son discovered the picture - which bore recognisable burns and scars - when he bought a packet of rolling tobacco last year in Luxembourg, French media report.

He brought the packet home to his family.

"He [my brother] was coming back from Luxembourg. Without saying a word, he put a big box of rolling tobacco on the table," the man's daughter told regional newspaper Le Républicain Lorrain.

"We were stunned. We did not believe it."

The family thought it was indeed a picture of the father's leg.

"It's our father's. His scars are characteristic," the daughter added.

The man, who has not been named, says he had never agreed to the picture being used. He believes it was taken at a local hospital he visited in 2018 to find out whether he could be fitted with some kind of walking apparatus.

He has been walking using crutches for more than 20 years following a shooting incident in Albania in 1997, in which he lost his leg.

'Betrayed'

The family's lawyer, Antoine Fittante, is also adamant that the picture is of his client's leg.

"Each scar is specific, unique. This man also has burn marks on the other leg, it's very clear. An expert will have no trouble identifying the image.

"It's rather incredible that a person finds themselves without their agreement on cigarette packets throughout the European Union," Mr Fittante said.

"My client feels betrayed, wounded in his dignity, by seeing his disability [displayed] on cigarette packets in tobacconists; one must admit that's not very pleasant."

Mr Fittante has written to the hospital to find out how the photos ended up being used.

Le Parisien newspaper, however, cast doubt on the claim by showing the same photograph in a collection used for an EU anti-tobacco campaign dated 2017 - before the man's visit to the Metz hospital. It also appears in an EU image database from 2014.

The newspaper also said it had contacted the hospital, which could not confirm the man's story.

"We have the identity, the agreement and the rights for all the people photographed for this campaign," a European Commission spokeswomen said, quoted by Le Parisien.

"From the information we have, we can say without a doubt that this individual is not one of them."

I support the ban of smoking in all public enclosed areas, and the fines on people who smoke in vehicles with children present - but it seems rather draconian and OTT to ban smoking in public parks - because it's in the open air.

Smoking in parks was nearly banned in the UK - but the former London Mayor Boris Johnson prevented such drastic measures. The UK has one of the lowest smoking rates in Europe anyway, along with Sweden and Iceland... and the smoking rate continues to fall each year in the UK due to all the devices and help available for people to quit.

We have a few outdoors areas here which have green 'clean air zone' signs stating that smoking is forbidden, and signs are usually displayed outside the doors of public buildings stating that smoking isn't allowed by the door area, but smoking is allowed in most outdoor areas of the UK, but not many people smoke.

The death rate in France from smoking is very high (70,000 smoking related deaths each year,) and whilst smoking keeps their weight down - it causes yellow and brown teeth, bad skin, premature ageing and wrinkles, smelly skin, breath, hair, clothes, discoloured nails, wrinkled and dry lips, black chimney lungs, coughing, eye health problems, infertity, low sperm counts, increased risks of cancers, lung problems asthma, heart attacks and strokes, affects oxygen supplies, and contains tar and carbon monoxide.

I think the French obsession with perfume is because they're aware that they often smell of stale smoke, onions and garlic, but perfume doesn't cover up the strong and bad smell of their breath and the stale ashtray smell on their skin, hair, nails, and clothing. You can smell a smoker standing some distance from them - and they smell like ashtrays.

Also cigarette butts on the ground causes an impact to wildlife, birds, and the environment.... so I support the £50 fines on litter bugs caught dropping butts on the ground. It's also the cause of some bush fires. A small pocket ashtray (from Amazon, etc,) safely extinguishes cigarettes and stores the butts.

CCTV cameras and eyewitnesses helps to catch the litter-bugs polluting the environment with cigarette butts all over the ground which gets into the beaks of birds and wildlife. The culprits DNA is also left on the butts.

The French don't smoke that much (look at the stats you posted just before you moron) and I don't think think they "smell of onions and garlic."

Hmm.. I am an occasional pipe smoker myself and I'm completely against the smoking bans in pubs and restaurants because these aren't government owned businesses and thus government should keep its ruddy nose out. That they even have the gall to legislate that there can be no smoking (or anything that has anything to do with these places !) in places they don't even control disgusts me. They don't even own schools (no: the government doesn't own the premise nor does it own the schools as institutions - according to art.23 of the constitution they merely facilitate) and hospitals (yes, I know.. but those are all privately owned and there is no such thing as actual government healthcare). they don't own the train company or the bus companies and they be told to push off. If the individual proprietor would see the need to ban smoking on site, well.. that's his right. But not the government. Do I think that smoking in schools and hospitals is a bad thing and that owners should have the common decency to separate smoking and non-smoking areas ? Well yes. Do I believe that there should be anti-smoking campaigns and that assistance to quit smoking should be covered by your healthcare providers ? Absolutely. But that's not up to the government. The government should first learn to master its key tasks: maintain public order, protect the border and run a budget. They can't even do that so, perhaps, they should leave things to the citizenry to work out amongst themselves as you really shouldn't put a toddler behind the wheel of a Porsche 911 and judging from the behaviour of the civil service and successive cabinets over the last 50 years: government is that toddler and society is that Porsche.

This man should be duly compensated and whoever used his picture without his permission should be sacked immediately (along with his supervisor) and agencies and pressure groups should learn to play by the rules.
