You are right. Before going to court, try to patch things up with her so you can see your son. If she refuses to let you spend time with him, collect evidence of your attempts at coming to terms with your ex and then head to court. You've been paying a monthly fee and have taken monetary responsibility for your son so they might side with you. Try to do things the simple way. If this doesn't work out, take legal actions.
