I'm not a lawyer but that sounds kind of dumb perhaps because humans can destroy ourselves many times over with nuclear weapons or whatnot. Then again maybe modern war laws do not involve nuclear warheads, germ warfare, and stuff etc... I'm not a lawyer.

The question is stupid.

Nations agree on laws of war with the thought of protecting their own troops and civilians in a war. Do you want your soldiers to be tortured and executed when taken prisoner? Do you want your women and children raped by an invading army?

Of course, atrocities still happen regardless because Man is Man, and whether soldiers will be kept in check is dependent on their officers.

Yup. A good example of this is the mass murder of Japanese and German civilians during WW2. Germans and Japanese soldiers committed horrendous acts of violence without question but the Allies did some horrible shit themselves. Only the losers hung for their crimes. The winners were given medals.
