It is the acursed "release em'" policy, where prison is the exception and not the rule, and felons need to have all matters of proof foisted on them in courts in order for them to be locked up. That same code is being exported to the undeveloped world, with the consequences you might expect. That's why I prefer the old Napoleonic penal code better, where "lock em up" was the rule, and judges had more or less a discretionary power of life and death over these criminals.
